LEGAL & SERVICE AGREEMENT

Terms of Service

Please read these terms carefully before utilizing the LoamCalc agronomic calculators, technical reference guides, or professional specification export features.

Last Updated: October 28, 2026

1. Acceptance of Terms

By accessing or utilizing the LoamCalc website (accessible at loamcalc.com), its interactive horticultural calculation tools, technical engineering documentation, or purchasing Pro contractor licenses, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all terms and conditions contained herein, you must refrain from using the platform.

These Terms constitute a legally binding agreement between you ("User", "Contractor", or "Client") and LoamCalc ("we", "us", or "our").

2. Agronomic Nature of Calculations & Engineering Estimation Limits

LoamCalc provides deterministic computational models for physical soil mechanics, compost stoichiometry, hydraulic drip irrigation manifold sizing, mulch coverage, container potting substrates, and N-P-K mineral fertilizer balancing. These mathematical models are derived from peer-reviewed horticultural science, USDA NRCS technical guidance, and the American Society of Agricultural and Biological Engineers (ASABE) standards.

However, natural agricultural environments are subject to substantial microclimate, biological, and material variability:

  • Bulk Density Variations: Quarry and landscape supply bulk materials (topsoil, triple-mix, compost, bark mulch, gravel) exhibit unpredictable moisture contents, compaction levels, and settlement settling curves that vary widely from supplier to supplier and following heavy rainfall.
  • Municipal & Well Pressure Fluctuations: Drip irrigation friction loss calculations assume steady input pressure and clean water viscosity. Real-world water supplies suffer diurnal municipal pressure surges, static head drops, and filter occlusion that can affect flow uniformity.
  • Biological Soil Chemistry: Organic matter decomposition kinetics, microbial Thiobacillus sulfur oxidation, and Rhizobium biological nitrogen fixation are strictly governed by unmeasured ambient soil temperatures, native microbiome populations, and subsoil drainage.

All calculation outputs are provided as deterministic engineering estimates intended to assist professional contractors, agronomists, and home horticulturists in procurement and design. Users are strongly advised to perform on-site jar settling tests, pressure gauge audits, and certified laboratory soil tests before procuring bulk commercial quantities or undertaking civil grading projects.

3. Contractor Pro License & Spec Sheet Export

LoamCalc offers both free open-access calculator utilities and paid "LoamCalc Pro" licenses enabling white-label, client-ready PDF specification sheets:

  • Commercial Use Permitted: Holders of an active LoamCalc Pro pass are granted a non-exclusive, worldwide license to generate, customize, download, print, and deliver client-facing PDF project estimates and material specification sheets bearing their proprietary contracting business name, branding, and contact details.
  • Non-Transferability: Pro licenses are tied to the purchasing contractor or organization. Reselling, sublicensing, or bundling direct API access to LoamCalc's proprietary calculation engines without express written authorization is strictly prohibited.
  • Payment Processing: All commercial transactions and digital pass purchases are securely processed via Stripe Inc. LoamCalc does not collect, store, or process raw credit card numbers or banking credentials.

4. Acceptable Use & Platform Integrity

You agree to utilize LoamCalc exclusively for lawful agricultural, educational, horticultural, and landscape contracting design purposes. You agree not to:

  • Deploy automated scrapers, web spiders, or automated bots to extract raw technical copy, guide tables, or calculation formulas in bulk without prior permission.
  • Attempt to reverse-engineer, decompile, or tamper with the client-side JavaScript calculation modules or Pro license verification routines.
  • Transmit malicious payloads, worms, or scripts designed to impair website uptime or degrade server performance.
  • Misrepresent calculation results or project spec sheets as certified civil or geotechnical engineering stamps where state or local building codes require formal licensed professional engineering review.

5. Intellectual Property & Copyright

All intellectual property on LoamCalc—including proprietary mathematical algorithms, user interface components, interactive calculator workflows, technical guide literature, bespoke SVG diagrams, and editorial copy—is owned by or licensed to LoamCalc and protected under international copyright, trademark, and trade dress regulations.

Open horticultural formulas and public domain agronomic equations (such as the Darcy-Weisbach or Hazen-Williams friction equations, USDA soil texture phase relationships, and stoichiometric lime chemistry) remain in the public domain. However, our unique computational implementations, explanatory annotations, comparative reference charts, and interactive web tools remain our proprietary property.

6. Warranty Disclaimer & Limitation of Liability

THE SERVICES, CALCULATORS, ARTICLES, AND MATERIAL SPECIFICATIONS PROVIDED ON LOAMCALC ARE FURNISHED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR AGRICULTURAL PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL LOAMCALC, ITS FOUNDERS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Material procurement shortfalls or surpluses resulting from unmeasured substrate settlement or quarry bulk density variance.
  • Crop yield loss, root asphyxiation, fertilizer salt toxicity, or soil over-acidification resulting from amendment applications.
  • Irrigation pipe blowout, emitter clogging, or water pressure failure.
  • Any interruption, technical defect, or server downtime affecting website access.

Our total aggregate liability for any claim arising out of or relating to these Terms or the use of LoamCalc shall not exceed the amount paid by you, if any, for accessing paid Pro services during the twelve (12) months preceding the claim.

7. Modifications to the Service & Terms

We reserve the right to modify, refine, or discontinue any aspect of our calculation models, guides, or feature sets at our sole discretion without prior notice. We may periodically update these Terms to reflect legislative changes, new features, or evolving agronomic best practices. Continued use of LoamCalc after any modifications signifies your binding acceptance of the updated Terms.
